Visa Extension for Thai Spouse

Do you have a Thai wife and want to live in Thailand? If you are married to a Thai national, you may be eligible for a visa extension based on having a Thai spouse.

There is no such thing as Marriage Visa but:

People regularly refer to a “marriage visa,” but the fact is that there is no such thing as a marriage visa on the books with the Thai Immigration Department. Instead, one can obtain a Non-Immigrant visa, then extend this visa based on having a legal Thai spouse.

Non-immigrant Visa for Thai Spouse

Do you want to live with your spouse permanently in Thailand? With marriage visas not offered by Thai immigration, you can apply for a non-immigrant Non-O visa at any Royal Thai Consulate or Thai Embassy.

But if you have any other type of non-immigrant visa, you might be eligible to extend it after having a legal Thai spouse

Extension of Visa:

Visas of non-immigrants are generally given for 90 days and are usually given to foreigners who intend on extending their stay. This Visa requires you to either extend your Visa by the end of the 90 days interval or leave Thailand. If you are married to a Thai national, you are eligible to extend your stay up to a year, so after 90 days, you may further extend your Visa to 275 days.

Conditions that need to be met: 

To be able to extend your Visa for 90 days and then a further of 275 days, you need to meet the following conditions:

  • You should be legally married to a Thai nationality holder spouse.
  • Your spouse must be at least 17 or older.
  • Your spouse should be a citizen of Thailandwith supporting identification proof. 
  • Your spouse should be only legally married to you and no one else.
  • You need to carry sufficient proof to be shown to the officials that you are married legally.
How The Process Works:

If you want to apply for a further extension, you should do it while your current Non-immigrant Visa is still valid at the local immigration office. You must present them with all the necessary paperwork mentioned above. 

Usually, you will be given a temporary extension of about 30 to 45 days if you have brought all the required documentation and submitted it to the local Immigration office. This period is usually called Under Consideration. During this time, you should get an extension for a one-year visa.

Once you are given the extension for your Visa, you need to report to the immigration office every 90 days, just like any other foreigner living in Thailand. 

Immigration Check at your Residence:

The first time you apply under the spouse application, you may expect an immigration officer to visit you physically to confirm your marital status and that you both are married. This usually involves an interview of you and your partner and the immigration officer taking statements from your local neighbors. 

Leaving Thailand:

If you have to leave Thailand for any period or any reason, you need first to get a re-entry permit. This could be attained from any local immigration office. It’s simply a stamp that the officer will put in your passport that would let you come back without any hassle. You should obtain the re-entry permit before leaving Thailand, and it is possible to also obtain a re-entry permit at any international airport in Thailand. The form is a TM8 to make an application for a re-entry permit

Working on a Spouse Visa

If you want to work in Thailand and under your spouse’s visa, the law allows you to do so as long as you obtain a work permit from the Labor Office. The process is straightforward as it consists of you submitting all of the detailed documentation to the Labor Office to get a work permit.

Documentation Required:

Following are the documentation required to present at the Immigration office:

  • Your passport. A thing to keep in mind is that your passport should have at least 6 months validity before expiring. 
  • There should be two new pages available in your passport. 
  • Three passport-sized pictures. 
  • The pictures should be clicked by a professional having a white background.
  • Photocopies of your passport. It should include all the relevant pages such as the personal information page, the latest entry stamp, your TM6 (Your departure card), details of any previous extensions, and your current Visa. 
  • Your wife’s I.C. card’s copy. Your wife’s house registration photocopy AKA Tabian Baan. 
  • If your marriage took place in Thailand, you would present your original Thai Marriage Certificate and their photocopy. 
  • A copy of your Affirmation of Freedom to Marry certificate, which the embassy usually issues before the marriage. 
  • If you were not married in Thailand, you would have to lodge a Family Status Registration (Kor Ror. 22). 
  • Also, a copy of the marriage certificate or marriage registration would have to be brought from overseas. 
  • If you were married in any other country than Thailand, you would have to legalize your marriage in Thailand through the embassy in Bangkok. 
  • For instance, suppose the spouse you were married to is from the U.K.; the British embassy is going to legalize your marriage. 
  • You will be required to present a copy of these documents and a certified translation that the Ministry of Foreign Affairs has verified. 
  • You will also have to present them proof that your monthly income is at least       THB40 000 per month. 
  • Your account should maintain a balance of not less than THB 400,000, and this amount is subject to change. This account should be solely in your applicant’s name, as a joint account will not be accepted. This balance must be confirmed less than seven days before the application. 
  • You will also need to put some pictures of you and your spouse inside and outside of your residence, in which your house should be clearly shown. 
  • Proof of your address, along with a map of the location. The latitude and longitude of your residence should also be mentioned. 
  • A copy of your ownership if you own the house. 
  • If the residence is on rent, you will need a signed copy of the rental agreement along with a copy of the landlord’s house registration, Thai ID card, or passport. 
  • You are required to visit the immigration office with your spouse personally. 
  • You will be required to sign all of the copies to self-attest. Sign with blue pen only.

Thai Marriage Visa Confirmation

If you have got a Thai Marriage Visa, know that it may be required to be confirmed (your marriage status every year, entailing the same application process as the original one).
